DMV Hearing

When a driver is arrested for DUI and fails or refuses a breath, blood, or urine test, automatic license suspension proceedings will be initiated by the DMV. The driver will have a very limited time to schedule an administrative hearing to challenge the suspension of his or her license.

This administrative hearing is held to review the evidence and to determine whether the driver was legally arrested, whether the tests were performed properly, and whether the driver actually refused a lawfully requested breath, blood, or urine test. Failing to schedule a hearing in time will result in automatic license suspension. Winning the hearing, however, will mean that the driver's administrative suspension is overturned and he or she may reinstate the driver's license.
