Modification of Spousal Support in Florida
How an Alimony Attorney Can Help
In today's chaotic economic climate, sudden unemployment or a change in jobs can cause a substantial change in one spouse's financial status. There are a number of circumstances recognized by Florida's courts that permit a decrease, increase or even the termination of alimony payments. If a spouse who has been ordered to pay spousal support / alimony following a Florida divorce finds that his or her financial circumstances have changed, he or she may wish to seek a modification of the divorce judgment.
Even if a couple agrees that a change is in order, the court will not recognize it unless a supplemental petition is filed and ruled upon.
If you have questions about your spousal support payments or feel there is a legitimate reason to seek a modification you should first speak to a lawyer at the Law Offices of Jason K.S. Porter, P.A. Unexpected medical emergencies, bankruptcy, or even the existence of a new and "supportive relationship" of the one receiving alimony can be grounds for a modification. When you call our office and arrange for an initial consultation, you will meet with a lawyer who can answer your questions and review your case. We can then advise you on your legal options and take the necessary steps with you.

Amend Your Spousal Support
If you are paying support and your ex-spouse is currently cohabitating with someone who is supporting him or her, you may be able to reduce or end your support payments. There are certain facts that must be proven to the court to substantiate such a claim. If you reach retirement and you income drops dramatically, you may be able to reduce or end your payments, as well.
If your ex-spouse experiences a significant increase in his or her income it is possible to seek an increase in alimony based on his or her new financial status. There are other situations that may require a temporary change in support, such as a lengthy hospital stay or a prison sentence, but merely losing a job is usually not considered a sufficient reason for a modification
