Visitation Rights Lawyer in Jacksonville
Protecting Your Right to Be with Your Child
Issues regarding parental rights to visitation can quickly become complex, which makes it vital to work with a knowledgeable Jacksonville visitation attorney from Jason K.S. Porter, P.A. We have helped many parents reach fair and equitable visitation agreements that work well for both parents and their children.
One of the most important parts of the child custody determination in a divorce proceeding is the right of each parent to have equitable visitation and access to their children. Recent changes in Florida law have made the right to visitation more balanced for fathers; however, the court always determines such matters based upon the best interests of the child.
Now known as time-sharing, many factors will be considered when establishing a parent's visitation rights, including:
- The parent's work schedule
- His or her relationship with the child
- How much time the parent can spend with the child
- The experience the parent has in bringing up a child
- The length of time at and stability of the child's current residence
- The willingness of the custodial parent to allow the nonresidential parent to visit the child
- How far away the parents live and work from each other
- The preference of the child
Determining a Fair and Reasonable Visitation Schedule
When one parent is named as the "primary custodial parent" in the divorce, the other parent is given "fair and reasonable" visitation. This language is a bit vague, as what is "fair and reasonable" to one parent may not be so to the other parent. It is crucial that the relationship between parents does not become irretrievably broken over this issue.

Many times when you meet attorneys to represent you, there are thoughts that reside in the back of your head...some good and some bad. "Are these guys REALLY going to help me," or "do they REALLY have my best interest," or "can I really trust them?" Those are the many thoughts, plus more, that I had--it did go away after my first initial visit with one of the attorney's at Jason's Porter's law office. For my case, I worked with two different attorneys which included Jason Porter himself. Both of those guys were with me 100% from the beginning, in court, after court, late in the evening by phone calls, text, and emails, it was a great experience. What was consistent and what I valued most is that I got to know both of them, what they like to do in their personal time with family, which felt like I could communicate openly and honestly. My case was a criminal case and because of them, I do not have to be viewed as a criminal. I want to share and express my gratitude for how they have helped me so others can choose Jason Porter.- JW

First and foremost, everyone from staff to the attorneys are all great!! I first started with the firm in 2015 and due to my own circumstances, I was unable to complete the needed court requirements in order to finalize my case. The amount I paid to retain an attorney was placed in a trust and they assured me it would be there until I completed my requirements. 4 years later they kept their word and finalized my case once I completed my needed court requirement. Everything was professional and in a timely fashion on their behalf. They also found a second issue that needed to be resolved and also completed that for me. Although I hope to never need their services again, if I do, I will definitely be giving them a call. Thank you, everyone!- Erik R.

Mr. Porter is an excellent attorney. He helped me and my teenage son through a very difficult situation. He was right there immediately ensuring we had representation. He even called to follow up to ensure we were ok. He is very passionate about helping his clients. He also does not try to charge you if he knows you don’t have a case. He’s very honest and a great person. Highly recommend him if you need legal advice. Kelley- K.H.

I first met Jason Porter in 2003, when our children attended a Christian Preschool together. I saw what he did within our community. He helped many of the families from the preschool over the years so when it came time that my family needed a lawyer I chose him. Jason has helped my family and several of my personal friends, all with positive outcomes. He is a seasoned professional that is respected within the law community. You will be treated with the utmost respect and compassion. I don't know another lawyer of his caliber that offers free consultations and you speak to him personally. Pick Porter.
