What Makes a Military Divorce More Complex?

Military divorces are influenced by both state and federal laws, complicating the way that assets are divided. In most cases, however, many states will allow military personnel to file for divorce where they are currently stationed.

Since overseas deployments can be lengthy, oftentimes child custody is granted to the non-military parent or to the parent who is least likely to deploy. As always, a judge will ultimately make a decision that is in alignment with the best interests of the child.

The division of military pensions is also problematic, as the 1982 Uniformed Services Former Spouses Protection Act (USFSPA) deemed them as marital property and can be divided. Depending on the length of the marriage, the non-military spouse may be entitled to up to half of their spouse’s military pension.
