What is a Bench Warrant?
A “warrant” is a document issued by a court authorizing law enforcement to arrest the person named in the warrant and bring them before a judge. Such a person is being charged with a crime or they’ve already been charged with a crime but they failed to appear in court, or they owe a fine, or he or she has failed to follow a court order and they are in contempt of court.
A “bench warrant” is a specific type of warrant that is issued when someone has failed to appear in court for a hearing. In other words, they weren’t sitting on the bench when they were supposed to. Once a bench warrant has been issued, the police can treat it the same as any other arrest warrant; they can even use it to arrest the person during a routine traffic stop.
Arrest Warrants vs. Bench Warrants: What’s the Difference?
The key difference between traditional arrest warrants and bench warrants is how they’re initiated. Bench warrants are initiated after an individual fails to show up in court. In contrast, arrest warrants are initiated by police officers who explain to a judge why they believe a suspect committed a crime (the officer shows “probable cause” as to why the person should be arrested).
When the officer is successful in convincing the judge, the judge signs off on a warrant and the police can proceed in making an arrest. Most often, law enforcement obtains warrants so they can make an arrest at the suspect’s home, usually early in the morning hours when the suspect is asleep and has their guard down.

First and foremost, everyone from staff to the attorneys are all great!! I first started with the firm in 2015 and due to my own circumstances, I was unable to complete the needed court requirements in order to finalize my case. However, the law can be black and white when there are several shades of grey. If a man has a beer in his own house after coming back from war but is only 20, should his dad be charged for contributing to the delinquency of a minor? Have you ever done something now looking back, it may not have been the best decision but nothing happened? That was not the case a few years ago to my family. A bad decision, one I am sure many of us have done in our younger days. A bad decision was made and it could have ruined a young man’s future. The courts are busy and things can fall through the cracks; I was making sure my son was not one of them. I knew Jason had worked for the District attorney’s office so he knew both sides of the law. He knew what the other side was going to do and say because he was there for many years. He prepared our family through each and every step. He made sure that we were proactive “getting ducks in a row” so to speak. If there was something mentioned, we had already taken care of it and showed no history and really no where for the other side to go. What could have been jail time ended up being a bump in the road.
