While the legislature does require some mandatory minimum penalties in
DUI sentencing, it does give the judge considerable discretion. This means
that the jail time, fine, community service and
vehicle impoundment penalties you receive may well depend on the attorney you select to represent
you. An experienced attorney may persuade the judge to issue only the
mandatory minimum penalties that the law requires and to allow other accommodations.
Some of the penalties that you may be facing include:
First Time DUI - Jail may range up to 6 months. If
BAC is over 0.15 percent, jail may be up to 9 months. The fine ranges from
$500 to $2000. License revocation has a mandatory minimum of 180. Impoundment
of vehicle is 10 days minimum. Community service is a minimum of 50 hours.
If you apply for a hardship license, you must complete DUI School and
possibly install an
ignition interlock device.
Multiple DUI – For the second DUI, there is a minimum 10 days of jail with a 9 month maximum.
For BAC of 0.15 percent and over, the maximum jail can be up to 12 months.
If this is your second DUI in five years, your license can be suspended
up to 5 years with a one year wait to apply for a hardship license. Fine
is from $1000 to $4000.
Felony DUI – A third DUI within a 10 year period or a DUI accident with serious bodily
injury is a felony DUI. Jail is a mandatory 30 days with a five year sentence
possible. Fine is from $2000 to $5000.
