Proving a Business Knew About the Hazard
A slip-and-fall claim is one type of premises liability claim.
When a fall involves a transitory foreign substance in a business, Florida Statute § 768.0755 places a specific burden on the injured person: you must show the business had actual or constructive knowledge of the dangerous condition.
Actual knowledge means the business, through its employees or management, was aware of the condition before the fall. Evidence of it can include employee statements and earlier complaints or reports about the same hazard.
Constructive knowledge applies when the business knew or should have known. It can be shown with circumstantial evidence that the condition existed long enough that the business should have known about it, or that it occurred with regularity and was therefore foreseeable. Falls caused by other kinds of hazards are measured against the owner's general duty of reasonable care.
Evidence that bears on these questions can be lost quickly, since surveillance video may be overwritten, and cleaning records are not kept indefinitely.
