How is property divided during divorce in Florida?
If you are considering
divorce, you may wonder what will happen to property and other assets that you
and your spouse have acquired before or during your marriage. Florida
follows the principle of equitable distribution. While this does not necessarily
mean equal distribution, it does mean fair distribution.
In considering the
distribution of property and assets, the court will first determine which property and assets are separately
owned and which are jointly owned. The court will allow each spouse to
retain his or her separate property. The court will then consider the
joint or marital property and attempt to fairly distribute it between
the spouses based on a number of different factors.
